{"id":3705,"date":"2020-09-21T15:42:31","date_gmt":"2020-09-21T15:42:31","guid":{"rendered":"https:\/\/patellawoffices.com\/blog\/?p=3705"},"modified":"2020-09-22T15:43:50","modified_gmt":"2020-09-22T15:43:50","slug":"caution-increased-fbar-enforcement","status":"publish","type":"post","link":"https:\/\/patellawoffices.com\/blog\/planning-for-tax-minimization\/caution-increased-fbar-enforcement\/","title":{"rendered":"Caution: Increased FBAR Enforcement"},"content":{"rendered":"\n<p>The last month or so has unfortunately seen a lot of FBAR enforcement court rulings against US taxpayers and in favor of the government. The Financial Crimes Enforcement Network (FinCEN) of the Department of the Treasury can levy high penalties for each year that a timely Form FinCEN 114 (also known as the FBAR) is not filed.<\/p>\n\n\n\n<p>In&nbsp;<em>United States v. Toth<\/em> (2020 D. Mass. 2020&nbsp;<a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.mad.174067\/gov.uscourts.mad.174067.175.0.pdf\">here<\/a>),\nthe Court granted the Government\u2019s motion for judgment that Toth was liable for\nthe FBAR civil willful penalty.&nbsp; The court held that the maximum penalty\nis the greater 50% of the account(s) that should have been reported or&nbsp;$100,000\n(instead of $100,000 maximum).&nbsp; The Government successfully proved\napplication of the FBAR willful penalty by a preponderance of the evidence that\nToth\u2019s failure to file FBAR was willful.&nbsp; <\/p>\n\n\n\n<p>In&nbsp;<em>United States v. DeMauro<\/em>&nbsp;(D. N.H. Dkt.\n17-cv-640-JL 8\/28\/20 <a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.nhd.47037\/gov.uscourts.nhd.47037.48.0.pdf\">here<\/a>),\nthe Court approved of the government\u2019s assessed FBAR willful penalty.&nbsp; The\nwillful FBAR penalty requires that the failure to report be willful.&nbsp;In\nthe FBAR civil penalty context, the Courts have held willfulness is (i)\nspecific knowing failure to file or (ii) willful blindness or reckless\ndisregard of the obligation to report. The Government successfully proved\napplication of the FBAR willful penalty by a preponderance of the evidence. <\/p>\n\n\n\n<p>In&nbsp;<em>United States v. Bernstein<\/em> (E.D. N.Y. 2020&nbsp;<a href=\"https:\/\/www.courtlistener.com\/recap\/gov.uscourts.nyed.433386\/gov.uscourts.nyed.433386.25.0.pdf\">here<\/a>),\nthe Court granted the Government\u2019s motion for judgment determining that the\ndefendants, husband and wife (\u201cBernsteins\u201d), were each subject to the willful\nFBAR penalty. For many years the Bernsteins had foreign accounts and did not\nfile FBARs, answered \u201cno\u201d on the IRS Form 1040 Schedule B Part III foreign\naccount signatory interest question, and did not report the income from the\nforeign accounts.&nbsp; Over the years, they did not tell their accountant\nabout the foreign accounts because they wanted to keep the accounts secret. The\nIRS assessed a willful FBAR penalty in the amount of $262,288. The Government successfully brought this penalty collection\nsuit&nbsp;for the FBAR willful penalties.<\/p>\n\n\n\n<p>The rulings should remind us all of the FBAR filing requirement and the government\u2019s vigilant enforcement. The IRS has in its arsenal many ways to find out about Americans\u2019 bank and or investment accounts they may have, how much money is in these accounts and where these people live. In addition, the US now also has tax information exchange agreements with many foreign governments. Therefore, all US persons should take the steps necessary to file your tax return(s) and report your foreign bank balances.
