{"id":4555,"date":"2023-06-12T20:32:17","date_gmt":"2023-06-12T20:32:17","guid":{"rendered":"https:\/\/patellawoffices.com\/blog\/?p=4555"},"modified":"2023-07-06T20:45:21","modified_gmt":"2023-07-06T20:45:21","slug":"watch-out-malta-pension-plans-become-listed-transaction","status":"publish","type":"post","link":"https:\/\/patellawoffices.com\/blog\/planning-for-tax-minimization\/watch-out-malta-pension-plans-become-listed-transaction\/","title":{"rendered":"Watch Out: Malta Pension Plans Become Listed Transaction"},"content":{"rendered":"\n<p>Last week, in a government notice of proposed rulemaking (<strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www.federalregister.gov\/documents\/2023\/06\/07\/2023-11861\/malta-personal-retirement-scheme-listed-transaction\" target=\"_blank\">REG-106227-22<\/a><\/strong>), US Treasury and the IRS issued proposed regulations that identify any transaction that is similar to a Malta personal retirement scheme as a \u201clisted transaction.\u201d\u00a0<\/p>\n\n\n\n<p>A listed transaction is a tax avoidance scheme that has been\nidentified by the IRS. Participants in listed transactions must file a\ndisclosure statement with the IRS and may be subject to significant penalties\nif they do not.&nbsp; Penalties that may be\nimposed on taxpayers who participate in a listed transaction: Accuracy-related\npenalty of 20% of the underpayment of tax attributable to the listed\ntransaction; Fraud penalty of 75% of the underpayment of tax attributable to\nthe listed transaction; Failure-to-disclose penalty of 75% of the underpayment\nof tax attributable to the listed transaction, plus $10,000.<\/p>\n\n\n\n<p>The IRS previously placed Malta personal retirement schemes on its \u201cDirty Dozen\u201d list in July 2021. According to the IRS, individuals that engage in such arrangements misconstrue the pension provisions of the Treaty to improperly claim an exemption from U.S. income tax, often on transfers of appreciated assets such as securities, annuities, or partnership interests and typically lacking a local connection in Malta. Such individuals may also fail to comply with their U.S. information reporting requirements. In December 2021, the IRS published a competent authority arrangement in which the U.S. and Maltese competent authorities agreed that individual retirement arrangements established under Malta\u2019s Retirement Pensions Act of 2011 are not considered \u201cpension funds\u201d and that distributions from such arrangements are not \u201cpensions or other similar remuneration\u201d for purposes of relevant provisions of the Treaty.<\/p>\n\n\n\n<p>Affected persons should watch out because the proposed regulations make clear that the IRS will take the position that taxpayers are not entitled to the purported tax benefits.
